The Supreme Court ruled that it is unfair to confiscate the land of the owner of the business building for assisting in prostitution.

The Supreme Court dismissed both the appeals of A and the prosecution, who are accused of assisting in prostitution, etc.

Earlier, the lower court considered it unfair to confiscate the building where prostitution took place from Mr. A, but to confiscate the land as separate real estate.

He added that if the land redevelopment proceeds in earnest, the economic value will be quite high, adding that even if the land is not confiscated, there seems to be no risk of Mr. A reoffending.

In response, the Supreme Court also determined that the court below did not misunderstand the law.

Mr. A is accused of assisting in prostitution in a building in Yeongdeungpo-gu, Seoul for nearly three months from February 2020.

A was sentenced to one and a half years in prison and confiscation of buildings and land in the first trial, but the confiscation of the land was destroyed in the appeal trial.
