The government held a cabinet meeting presided over by Prime Minister Han Duck-soo at 10 a.m. today and voted to re-discuss the bill of Kim Gun-hee, which was spearheaded by the opposition party.
If President Yoon Suk Yeol approves it as early as today, he will exercise his third veto over the special prosecution law related to Kim.
Prime Minister Han criticized the opposition party in the plenary session of the National Assembly on the 14th for unilaterally passing the Kim Gun-hee independent counsel law without any consultation with the ruling party.
He also pointed out that the special prosecutor's bill violated the constitutional principle of separation of powers and the principle of exceptionalism of the special prosecutor system, and that it was clearly unconstitutional because it could undermine the foundation of the judicial system.
For this reason, he explained that he made two requests for reconsideration in the 21st and 22nd National Assembly, and all of them were rejected in the National Assembly's re-decision and disposed of.
Prime Minister Han said he is very sorry and sorry that the opposition party has yet to pass another independent counsel bill that has not been resolved at all.
In particular, the special prosecution bill was revised by the chief justice of the Supreme Court to exercise the right to recommend candidates for special prosecution, but he said that if the candidate recommended by the chief justice was deemed inappropriate, the opposition party could exercise its "right to veto" indefinitely, allowing the opposition to control the recommendation of special prosecution candidates.
Prime Minister Han told the opposition that the government knew it had no choice but to exercise its right to demand reconsideration on the special prosecution bill that conflicts with the Constitution, but argued that if it was intended to encourage the government and the National Assembly to put pressure on the state affairs, it was not up to the people to join forces to live a difficult life.
He also emphasized the legitimacy of the exercise of the right to demand reconsideration, saying that the right to demand reconsideration is almost the only means for the president to check the abuse of the legislature's authority.
Earlier, at a press conference on the 7th, President Yoon expressed his intention to veto a third time, saying, "Although the investigation into Kim has already been conducted sufficiently, the prosecution has not even been able to prosecute him," adding that it is against the Constitution to appoint an independent counsel against the president and the ruling party.
