The Constitutional Court has repeatedly confirmed its position that the case can be heard in a six-member system.

Kim Jung-won, secretary-general of the Constitutional Court, told a plenary session of the National Assembly's Legislation and Judiciary Committee today that the court is judging that there is no legal problem with the six people starting the hearing.

Article 23 of the Constitutional Act says that the case will be heard with the attendance of seven or more judges, but the effect of the provision was temporarily suspended after accepting an injunction filed by Lee Jin-sook, chairman of the Korea Communications Commission who was indicted on impeachment.

In response, Secretary-General Kim Jung-won explained that the court believes that the suspension of effect applies not only to Lee Jin-sook's impeachment trial, but also to all cases.
