The Constitutional Court has ordered the President of Yoon Suk Yeol to submit the minutes and proclamation of the emergency martial state council meeting.

It seems to be trying to see if there are any violations of the most basic procedures or unconstitutional factors related to the declaration of emergency martial law.

It has been five days since the impeachment motion against President Yoon Suk Yeol was delivered to the Constitutional Court.

The Constitutional Court asked the president to submit the minutes of the Cabinet meeting and decree No. 1 held on the 3rd night of the emergency martial law.

In the case of the minutes of the Cabinet meeting, the existence has not yet been confirmed.

The president claims to have gone through the process of a Cabinet meeting just before martial law was declared, but Prime Minister Han Deok-soo and other Cabinet members say there was no proper beginning and end to the meeting, and there were no official documents such as minutes.

[Yoon Suk Yeol / President (last 12th): The Office of the President and some members of the Cabinet were informed at a Cabinet meeting just before the declaration. There were also many dissenting opinions that were concerned from the perspective of their work.]

{Acting Minister of Public Administration and Security (last 13th): We have not been able to confirm the substance, format and procedure of the meeting. (Do you have minutes?) No minutes.]

The decree No. 1 was delivered to the whole nation at 11:30 p.m. on the 3rd through the media and SNS.

This submission order is to determine whether decree No. 1 is unconstitutional.

In particular, the part that tried to fundamentally block the lifting of the emergency martial law by including the "prohibition of political activities of the National Assembly" in Paragraph 1 of the decree,
Constitutional scholars generally analyze that paragraph 5 that includes
'medical punishment' and paragraph 3 that stipulates 'control of media and publication of martial law' are likely to be unconstitutional.

The Constitutional Court referred the martial law-related constitutional petition to a formal trial procedure
Asked whether he had ruled out President Yoon's claim that the martial law of
is not subject to judicial review,
The
All Tribunal has said that it can be dismissed and that it has not yet made a judgment.
