Constitutional Judge Candidates "right to appoint acting president, conforming to the Constitution"

Ahead of the National Assembly's confirmation hearing, the three candidates for the Constitutional Court expressed their view that it is in line with the purpose of the Constitution that the acting president appoints a constitutional judge elected by the National Assembly.

Cho Han-chang, a candidate recommended by the People's Power, and Ma Eun-hyuk, a candidate recommended by the Democratic Party, said in a reply to the National Assembly that if the National Assembly elected a certain person as a judge through due process, it would be in line with the purpose of the constitutional provisions to appoint the president or acting president.

The political candidate explained that the National Assembly has the de facto authority to appoint constitutional judges recommended by the National Assembly.

He added that if a judge's vacancy occurs because he does not voluntarily exercise his right to appoint, there is a serious problem with the protection of people's rights and the objective nature of the constitutional trial, which could be unconstitutional.
