The Ministry of Employment and Labor determined that the girl group Newzins, who complained of being bullied at work, is not a worker under the current law.

As a result, complaints of workplace harassment filed by fans were also closed without follow-up.

Hani, a member of girl group New Jeans, testified at the parliamentary audit last month that she had been ostracized within Hive.

[Hani / Group 'Newzins']: The manager made eye contact with me and told the following member to ignore me. (CEO Kim Joo-young) kept trying to move on. I'm convinced that the company doesn't like us. If I respect you as a human being, I think there will be at least no problems of bullying and bullying in the workplace.]

It is alleged that Hani greeted celebrities and managers of the same agency during a YouTube live broadcast in September, instructing them to ignore it.

A Newzins fan who saw the video filed a complaint through the National Newspaper, and the Ministry of Employment and Labor launched a review.

However, the Ministry of Labor closed the complaint.

Since New Jeans Hani cannot be seen as a worker, she is not subject to judging whether she is bullied in the workplace.

The Ministry of Labor said Hani's management contract makes it difficult to say that she is a worker under the Labor Standards Act, which provides work for wages in a relationship of use and dependency.

It is a relationship that fulfills its obligations in the position of equal contracting parties.

It also cited the fact that the company's employment rules and systems that apply to ordinary employees are not applied, and that certain working hours or places are not set.

In addition, the amount paid to Hani is the nature of profit distribution, and it is also based on the judgment that each person pays taxes and pays business income tax rather than earned income.

Earlier, the Supreme Court ruled in September 2019 that the nature of the celebrity exclusive contract was an anonymous contract similar to the civil law mandate contract, and did not regard celebrities as workers.

The government also judged celebrities as "exceptional targets" who signed exclusive contracts with agencies in 2010.
