Jeong, a resignation major who was arrested for writing and distributing the so-called "medical blacklist," admitted the facts at the first hearing, but denied all charges of indictment.

Chung's lawyer said at a trial on charges of violating the Stalking Punishment Act held at the Seoul Central District Court on the 22nd, "Although we acknowledge objective facts, legal evaluation is difficult to punish for stalking crimes."

"Stalking should go against the other person's will and cause anxiety and fear in the other person through a specific person," the lawyer said. "It should also have continuity and repeatability, but it is questionable whether it meets this requirement."

"There are 1,100 victims listed on the crime list, of which 485 are posted only once or twice, and 44 are only three times," he said. "It is difficult to say that the act of disclosing personal information has been continuously and repeatedly."

"In addition, only some of the victims stated that they felt anxious, afraid, and psychological pressure from the defendant's actions, while the rest talked about simple discomfort," he added. "About 13 of the victims submitted a petition to the court."

In the bail (release with conditions such as deposits) questioning that followed the first trial, Jeong asked for his release, saying, "I have done nothing to harm the victims except for posting the list of victims, and I have no intention of harming my fellow doctors."

On the other hand, the prosecution said, "We have made fellow doctors criticized for their distorted perception beyond opposition to government policy," adding, "We should be concerned about secondary abuse and another stigma."

Chung was arrested on the 15th of last month on charges of creating a list of 1,100 medical doctors and medical students who did not participate in the collective action against the government's policy of increasing medical schools from June to September and posting them 26 times on MediStaff, a community of Telegram doctors and medical students.
