A man in his 50s who tried to kidnap a 6-year-old child who was left alone in the vehicle was released from an appeals court.

On the 25th, the Incheon District Court's Criminal Appeals Department 3 (Chief Judge Choi Sung-bae) reversed the original trial, which sentenced A (55), who was handed over to trial on charges of attempted underage drug use and assault, to six months in prison and two years of probation. As a result, A was released.

The appeals court also ordered A to undergo probation.

A was indicted on charges of attempting to kidnap B (6) on the street in downtown Incheon at around 4 p.m. on July 7 last year. At that time, B was reportedly alone in a parked vehicle while his parents went to buy goods for a while.

After getting in the driver's seat, A threatened B, saying, "I'll kill you," and tried to drive the vehicle, but was stopped by an elementary school teacher nearby.

A was also accused of assaulting C (8) in front of a nearby convenience store about 10 minutes before the crime, by approaching C (8) and pulling his arm, saying, "I will kill you."

"The defendant's crime against minors is very poor," the appeals court said, judging that "it is a serious crime that can traumatize the victim and his family."

However, he said, "The defendant is deeply reflecting on his wrongdoings while acknowledging all the crimes," adding, "We considered the fact that it appeared to have been committed accidentally under the influence of alcohol and agreed smoothly with the legal representative of one of the victims at the appeal trial."
