A court ruled that even if an elderly person died of abuse in a nursing home, it would be too much to deprive the institution of its operating qualifications.
On September 26, the Seoul Administrative Court ruled in favor of the plaintiff in the first trial of a lawsuit against the head of Eunpyeong-gu, Seoul, filed by A to cancel the designation of a nursing institution.
Earlier in February last year, an elderly man died due to abuse by a nursing care worker at an elderly nursing home in Paju, Gyeonggi-do, operated by A Bokjiwon, and Eunpyeong-gu Office canceled the designation of a nursing institution.
Although the nursing home neglected to manage and supervise, the court ruled that canceling the designation of the institution was too heavy for the degree of violation of the obligation, considering that the nursing home had never been administered before and that the nursing care worker in question resigned.
