The prosecution appealed against the first trial's judgment that Lee Jae-myung, the leader of the Democratic Party of Korea, was found not guilty of perjury.
The Seoul Central District Prosecutors' Office said today (29th) that it is filing an appeal to correct the first trial ruling that acquitted Lee because there was a clear misunderstanding of facts and a serious misunderstanding of the law.
Prosecutors pointed out that according to the Supreme Court's case for perjury, the testimony should be judged as one, but the court broke down the testimony and judged it individually to conclude that it was inconsistent with the facts and legal principles.
Specifically, the court admitted that Kim Jin-sung's perjury was due to the teacher, but explained that it was not common sense and logic to judge that the beneficiary, Lee, was not intentional and was only a normal request for testimony.
He also said that there was a violation of the rules of evidence and contradiction of reasons, such as judging that there was no request for testimony on the part that Kim did not remember, even though it was clear in the transcript that Kim asked to tell him what he did not remember.
Earlier on the 25th, the Seoul Central District Court acquitted Lee of perjury teacher charges in the first trial, saying that it is true that Kim perjured at the request of Lee, but that he was not aware of the perjunction.
