Korea's criminal law allows the maximum death penalty to be sentenced like the head even if he participates in a rebellion plot or takes on important duties, and holds him seriously responsible.
In the case of the December 12 military revolt in 1979, which is mainly compared to this emergency martial law, most of the important mission chiefs were sentenced to heavy punishment.

Article 87 of the Criminal Code stipulates that those who commit civil war should be punished by dividing them into three categories: the head, important mission workers, and simple participants.
Among them, the head will be sentenced to life imprisonment (custody) and the maximum death penalty.
What kind of punishment was given to the participants during the December 12 military revolt in the past?
Former President Chun Doo-hwan, who was the head of the group, was sentenced to death in the first trial, and the security commander at the time was finally sentenced to life imprisonment.
An important task worker refers to a person who participates in or directs a conspiracy, ranging from imprisonment for more than five years to the maximum death penalty.
Former President Roh Tae-woo, who was an "important mission worker" on December 12, was sentenced to 17 years in prison at the time, Heo Hwa-pyeong, chief of staff to the security commander, was sentenced to 8 years in prison, and Lee Hee-sung, commander of martial law, was sentenced to 7 years in prison.
The December 3 emergency martial law situation is expected to include Defense Minister Kim Yong-hyun, Army Chief of Staff Park An-soo, who was the martial law commander, Yeo In-hyeong, the counterintelligence commander, and National Police Agency Commissioner Jo Ji-ho.
Wouldn't it be a little difficult to avoid this kind of allegation of emergency martial law or a civil war that is said to be involved in it?.
The last category, 'simple participant', refers to a person who simply participates according to instructions, and can be sentenced to up to five years in prison.
It is expected that the general military and police, which were put into lockdown such as the National Assembly and the NEC, will be targeted.
In the past, simple participants in the December 12 military revolt were not prosecuted.
