The Supreme Court ruled that a state that did not properly guarantee the right to access facilities for the disabled is responsible for compensating the parties for damages.

The Supreme Court's en banc reversed the lower court's decision to win some of the plaintiffs in a discrimination relief lawsuit filed by three people, including Kim, against the state.

The Supreme Court directly ordered the government to pay 100,000 won per person to two disabled plaintiffs.

Earlier, Kim and others filed a compensation suit against the government in 2018, saying that if the floor area of small retail stores such as convenience stores is not 300 square meters, it is the state's responsibility to maintain the enforcement decree, which was excluded from the obligation to install ramps for the disabled, for more than 20 years from 1998.

The Supreme Court explained that the government is responsible for compensating for mental damage, saying that the government's failure to comply with the improvement legislation has caused disabled people to live without enjoying the dignity and equal rights guaranteed by the Constitution.
