Acting President Impeachment Quotient According to the Constitutional Court's commentary, "Depending on the timing of the reason for impeachment."

Amid conflicting opinions between the ruling and opposition parties over the quorum for impeachment of Acting President Han Deok-soo, the commentary on the Constitutional Court Act was found to include that the quorum should be set differently depending on the time when the illegal act was committed.

The commentary on the statute published by the Constitutional Court's Constitutional Court in 2015 said that if the acting president is impeached, the quorum of decisions will be based on the status of the acting public official.

In addition, he stated that only illegal acts during the execution of his duties as an agent are grounds for impeachment, and according to this interpretation, an agent's impeachment quorum requires two-thirds of the registered members' consent in accordance with the president's impeachment standards.

However, the commentary also explained that illegal acts during the original execution of the agency's duties are subject to impeachment as their original status.

In other words, it is interpreted that impeachment is possible if 151 people, the standard for impeachment of the State Council members, agree if the misconduct is raised to the reason for impeachment during the execution of the prime minister's duties.

In this regard, an official of the Constitutional Court explained that although the commentary was published by the Constitutional Court, it was not a book that contained the official position of the Constitutional Court, but it was written by the author's opinion.
