The court sentence for perjury teacher charges applied to CEO Lee Jae-myung is "imprisonment of up to five years or a fine of up to 10 million won."
If the Supreme Court confirms it after being acquitted in the first trial, the perjury teacher charge does not shake Lee Jae-myung's presidential election schedule.
However, if found guilty, he will be sentenced to one of imprisonment or fine, which greatly affects his eligibility for the next presidential election depending on what sentence and how much he is sentenced.
First, there are no restrictions on running if a fine is issued.
Unlike election crimes that limit the right to run for election if a fine of more than 1 million won is confirmed, general criminal crimes limit the eligibility to run from the confirmation of imprisonment or higher.
However, when a sentence heavier than a fine is sentenced, the number of cases becomes complicated.
In the case of imprisonment, if the sentence exceeds three years, the person will be deprived of the right to run for 10 years after the execution of the sentence and five years for less than three years, and representative Lee will not be able to run for the next presidential election in both cases.
However, if a suspended prison sentence is sentenced, it must be interpreted by the National Election Commission.
This is because there are different views that the right to run for election will be created after the probation period is over and that the right to run for election will only be created after the sentence is "effective" after the probation period is over.
For now, the NEC interprets that the right to run for election is limited only during the probation period, but the possibility of leading to legal disputes cannot be ruled out.
Apart from this case, Lee has been sentenced to deprivation of his right to run in the first trial on charges of violating the Public Official Election Act, and if he is finally guilty in both cases, his eligibility to run will be limited based on the case of a longer period.
