Human Rights Commission "Foreigners in Refugee Litigation should not be detained for a long time."

The National Human Rights Commission of Korea has called for and recommended the temporary release of detention for foreigners who are in long-term detention centers while refugee litigation is underway.

The National Human Rights Commission judged that it is a violation of excessive freedom to detain Mr. A for a long time even though he cannot be forcibly evicted, and that the detention needs to be temporarily lifted under conditions such as a deposit or housing restrictions.

A Russian national man entered Korea in 2019, and he was detained in a foreign shelter after staying illegally to avoid conscription when the war between Russia and Ukraine broke out.

Since then, the refugee application filed by A has been decided against, and A has filed a lawsuit in September last year asking for the cancellation of the rejection decision.
