Compensation for 'force majeure delivery medical accidents' will be raised to up to 300 million won.

The Ministry of Health and Welfare announced a legislative amendment to the Enforcement Decree of the Medical Accident Damage Relief and Medical Dispute Mediation Act to strengthen national responsibility for medical accidents that inevitably occurred during delivery.

For force majeure delivery medical accidents, the limit of compensation paid by the state's financial resources will be raised from up to 30 million won to 300 million won, and the Minister of Health and Welfare will form a compensation review committee.

In addition, in order to revitalize the simplified adjustment system that allows victims to receive relief quickly, the scope of related small cases will be expanded from the current 5 million won to 10 million won.

Force majeure delivery medical accidents are medical accidents related to delivery, such as the death of a mother or newborn baby or cerebral palsy disorder in the newborn when the medical staff has fully fulfilled their duty of care.

The legislative notice period for the revision of the enforcement ordinance and enforcement regulations of the law is from today (24th) to December 3rd.
