It has been judged that writing sexually disparaging and insulting the victims of the Itaewon disaster on a chat window that can be viewed by an unspecified number of people could be equivalent to the distribution of pornography.
The Supreme Court recently returned the case to the Seoul Central District Court, breaking the original ruling that acquitted A, who was accused of spreading pornography under the Information and Communication Network Act.
In October 2022, shortly after the Itaewon disaster, Mr. A was charged with sexually disparaging and insulting the female victims of the Itaewon disaster in an online game chat room.
Earlier, the first and second trials acquitted Mr. A's message, saying it was difficult to say that it was obscene.
However, the Supreme Court considered that A expressed illegal and antisocial sexual behavior by demeaning the dead, and judged that it could be seen that he seriously damaged his dignity and values.
