MBC Wins Penalty Complaint Litigation..."Council Committee failed to reach a quorum."

MBC, which was fined 15 million won by citing Newstapa's so-called "Kim Man-bae and Shin Hak-rim Interview," filed an objection lawsuit and won.

The Seoul Administrative Court ruled in favor of the plaintiff in the first trial of an administrative lawsuit filed by MBC against the Korea Communications Commission today (17th) to cancel the penalty.

The court judged that the decision to impose sanctions under the two-member system of the Korea Communications Commission failed to meet the quorum requirements, considering the legislative purpose of the Korea Communications Commission Act.

At the time of the penalty disposition, the KCC pointed out that the number of members for practical discussions was not guaranteed, saying that at least three members were logically required for the precondition of the majority rule to be established.

This is the first time that the court has judged the procedural illegality of the disposition made under the two-person system of the Korea Communications Commission in the main lawsuit.

In January, the Korea Communications Commission fined MBC PD Notebook 15 million won, citing Newstapa's "Kim Man-bae-Shin Hak-rim Interview," for reporting false interviews.
