A man in his 20s who was charged with sexually assaulting his intellectually disabled sister as soon as he was released from prison after serving six years in prison for sex crimes was sentenced to a higher sentence in the appeal trial.

On the 17th, the Busan High Court's Criminal Division 2 (Chief Judge Lee Jae-wook) reversed the court case and sentenced him to 12 years in prison at a sentencing hearing for A (20s) accused of violating the Special Act on the Punishment of Sexual Violence Crimes.

In addition, it maintained a 10-year order to attach location-tracking electronic devices and restrict employment of children, adolescents, and disabled organizations for 10 years.

The first trial court sentenced A to nine years in prison in June, but the prosecutor appealed, saying the sentence was too small.

"As the victim's brother, A not only targeted the victim to vent his sexual desire even though he had to protect the victim with intellectual disabilities, but also threatened or coaxed the victim to hide it after the crime," the appeals court said. "He delayed his guilt by saying it was because of drinking during the investigation stage."

"A seems to have difficulty in getting rid of his distorted sexual desire, such as committing another crime immediately after he was released from prison after completing his sentence, and the risk of recidivism is considerably high," he said. "Considering various circumstances, the lower court's sentence is considered unfair because it is light."

A is suspected of sexually assaulting his younger sister B (20s), who has a severe intellectual disability, in a motel room in Yeonje-gu, Busan on February 13. At the time of the crime, A was only 11 days after he was released from prison after being sentenced to six years in prison for rape and attempted rape.

Meanwhile, the Korean Sex Offender Risk Assessment Scale (KSORAS) evaluation of A showed a total score of 22 points, A's risk of recidivism of sex crimes is "high," and the psychotic personality characteristics are "medium" with a total score of 21 points as a result of the PCL-R evaluation.
