Disagreements between the court and the prosecution over the 'pre-examination issue of the seizure warrant'

Prosecutors and courts have recently exposed differences over the preliminary interrogation system for search and seizure warrants being pursued by the opposition.

Chun Dae-yup, the head of the National Court Administration, appeared at a comprehensive audit of the National Assembly's Legislative and Judiciary Committee today (25th) to say that storage media such as mobile phones contain a person's full personality and are being approached carefully globally, and to affirm the need for the system.

On the other hand, Prosecutor General Shim Woo-jung expressed concern that the seizure and search are mainly conducted in the early stages of the investigation, and that if the system is implemented, it will have a great impact on the confidentiality and speed of the investigation.

Justice Minister Park Sung-jae also suggested a way to supplement the current system, saying that it is possible to guarantee the right to participate in the process of extracting confiscated objects after seizure.

The preliminary examination system for search and seizure warrants is a system in which judges call in prosecutors and judicial police officers before issuing search and seizure warrants, and was led by the Supreme Court last year, and is now proposed as a bill by Democratic Party lawmaker Park Joo-min.
