Moon Sang-ho, commander of intelligence, claimed that he only followed the instructions of former Defense Minister Kim Yong-hyun and was not specifically involved in martial law, but suspicions grew out of control.

The police special investigation team urgently arrested Commander Moon and former intelligence commander Roh Sang-won, who is suspected of being involved in drafting the decree, keeping in mind that the intelligence officer was deeply involved from the preparation stage of martial law.

However, the prosecution did not approve the emergency arrest of Commander Moon, saying that the arrest of active-duty soldiers by civilian police violates the jurisdiction of the Military Court Act.

However, he approved the arrest of former commander Roh, who is a civilian.

The special team immediately protested the prosecution's disapproval, saying it was regrettable.

The police argued that it is not logical that the prosecution did not approve the emergency arrest due to the jurisdiction, even though the investigation and jurisdiction are separate.

Even after the release of Commander Moon, the special forces continued to investigate further, but some are concerned about the disruption of police investigations into other active-duty soldiers for similar reasons in the future.

A special team official explained that they are considering applying for an arrest warrant for Commander Moon through the Crime Investigation Office of high-ranking public officials who have launched a joint investigation.
