The Supreme Court ruled that conditional regular bonuses paid based on tenure or working conditions for a certain period of time should also be included in ordinary wages.

After 11 years, the government overturned existing precedents and abolished "fixedness," one of the standard wage standards, and the interpretation of ordinary wages under the newly changed law will be applied from the time of sentencing.

The legal concept of ordinary wages, which is the basis for calculating work allowances and annual paid leave allowances, has changed in 11 years.

The Supreme Court announced that it would discard the "fixed" standard of ordinary wages, ruling out appeals filed against the company by Hanwha Life Insurance and current and former workers of Hyundai Motor Co.

In 2013, the Supreme Court overturned the normal wage standard established by the Supreme Court as an all-in-one decision.

Until now, the conditions of ordinary wages have been judged by three requirements: regularity, uniformity, and fixedness, but

The Supreme Court excluded the concept of 'fixedness', saying it unreasonably reduces the scope of ordinary wages.

It is explained that if a worker fully provides a certain amount of work, the wages paid regularly and uniformly in return correspond to ordinary wages.

Labor immediately welcomed the move.

It is also expected to have a large impact on the industry.

Earlier, the Korea Employers Federation estimated that if conditional bonuses were included in ordinary wages, labor costs would be 6.8 trillion won per year,
The
business community expressed regret over the ruling, fearing the burden on businesses.

In order to protect legal stability and trust, the Supreme Court decided to apply the new law from the calculation of ordinary wages after the ruling.
