The 78-year-old Choi Mal-ja, who was sentenced to prison 60 years ago for biting the tongue of a man who tried to rape her, opened the way for a retrial.

It was a case in which self-defense was not recognized in criminal law textbooks, and unlike the first and second trials, which rejected the request for retrial, the Supreme Court saw the need to reconsider the case at the time.

In May 1964, Choi Mal-ja, an 18-year-old girl, was put on trial for biting the tongue of a man in his 20s who was trying to rape her and cutting her off.

He insisted on self-defense, but the court refused to accept it at the time, and was eventually sentenced to 10 months in prison and two years of probation.

The sentence was heavier than six months in prison and two years of probation for a man who attempted sexual assault.

In addition to this, the second offense added to the investigation process.Grandmother

, took courage and filed for a retrial after 56 years in 2020.

At that time, the court returned the case to the Busan High Court, judging that the reason for the retrial of Choi, who claimed illegal arrest and imprisonment during the investigation, was credible.

The case of Choi, who was also included in the criminal law textbook as an example of self-defense.

Our society is paying attention to whether a girl who was seriously injured and stood in court as a defendant can stand again as a victim after 60 years.
