An accident investigation is being conducted to find out who is responsible for the Jeju Air disaster that killed numerous people.

If a defect in the aircraft is included in the cause of the accident due to management, Jeju Air may be booked up to its representative for violating the Serious Accident Penalty Act.

The Serious Accident Punishment Act is divided into serious industrial accidents and serious civil accidents depending on whether the victim is a worker or a citizen.

This accident is true of both disasters in that 175 passengers and six crew members were killed or injured.

Experts have no doubt that the accident is subject to the Serious Accident Punishment Act.

However, just because it is subject to the law does not mean that it is punished.

In accordance with the Aviation Safety Act for serious civil accidents and the Industrial Safety Act for serious industrial accidents, if the person in charge fails to fulfill safety obligations and management measures.

Therefore, first of all, the clear cause of the accident must be identified.

If the investigation showed that the control defect was the direct cause, even the representative of Jeju Air could be subject to a charge.

The 2023 Ministry of Land, Infrastructure and Transport's commentary on major civil disasters introduces a case of a virtual accident in which an aircraft crashed during landing due to a flight defect.

It explains that the CEO of the airline can be sentenced to more than one year in prison or fined up to 1 billion won for violating the Serious Accident Punishment Act for one person killed and five others injured.
