Spondylitis after discharge...The Supreme Court said, "I can't determine the hospital's fault."

The Supreme Court ruled that even if an acute infection was diagnosed after surgery, it should not be concluded that there was hospital negligence.


The Supreme Court sent the case back to the Seoul Northern District Court on the 27th of last month, breaking the original ruling that Mr. Kim won part of the plaintiff in a lawsuit against a hospital doctor and the hospital director.

The Supreme Court said it is difficult to rule out the possibility that the causative agent in Kim's other body parts caused the surgical site infection through blood flow.

Kim was diagnosed with spondylitis by visiting the hospital with a high fever two weeks after being discharged from hospital after undergoing spinal surgery in March 2018.

Kim filed a lawsuit against the hospital and doctor, claiming that the medical staff did not fulfill their duty of care, causing an infection in the surgical site, and the appeals court overturned the plaintiff's defeat in the first trial and ruled that the hospital should pay 24 million won.

The appeals court heard that most of Kim's diseases are caused by direct contamination of germs during surgery.
