Supreme Court nominee Ma Yong-joo said Han Deok-soo, acting president, can appoint a candidate for constitutional justice.
During his confirmation hearing at the National Assembly today (26th), candidate Ma said that the three constitutional judges, who are responsible for the election of the National Assembly, should be appointed by the appointee if the National Assembly decides to elect them in accordance with due process.
When asked by So Byung-hoon of the Democratic Party of Korea whether it was against the Constitution to ban the legislature from participating in the National Assembly in martial law decree No. 1, he answered, "I think so."
When asked by Rep. Cheon Ha-ram of the New Reform Party whether he thought the emergency martial law was justified, he said it would be difficult for not only himself but also the people to agree easily in light of constitutional and martial law regulations.
