If the head of the Constitutional Court is unable to perform his duties or becomes vacant, a bill has passed the plenary session of the National Assembly that stipulates the process of appointing an acting president.
The National Assembly passed an amendment to the Constitutional Court Act, including this.
The amendment stipulated that when the head of the Constitutional Court is unable to perform his/her duties due to a temporary accident, he/she shall act in the order of his/her appointment, and when the appointment date is the same, he/she shall act in the order of senior citizens.
In addition, when the head of the Constitutional Court is vacant or he is unable to perform his duties for more than a month due to an accident, an acting president is elected at a meeting of judges.
Although the process of appointing the acting head of the Constitutional Court was stipulated by the enforcement decree, the revision was pushed forward as it was pointed out that it should be stipulated by law in consideration of the importance of the Constitutional Court.
