When the request for an arrest warrant against President Yoon Suk Yeol was made public, President Yoon's lawyers immediately submitted a letter to the court.
This is in contrast to the fact that the police, prosecutors, and high-ranking government officials have consistently responded to the summons notification.
The lawyers also submitted an eight-page opinion to the Seoul Western District Court. In his opinion, President
Yoon argued that the prosecution did not have the authority to investigate the president, the Senior Civil Servant Corruption Investigations Unit did not have the authority to investigate rebellion, and that it was an abuse of authority by the investigative agency.
At the same time, he pointed out that it is excessive for the Senior Civil Servant Corruption Investigations Unit to investigate the crime of rebellion by combining it with charges of abuse of authority.
[Yoon Gap-geun / Yoon Suk Yeol's lawyer] It's like claiming ownership of the tree because the leaves came over the fence. I think it's that weird logic of claiming the right to the body because you have the right to a certain tail.
On the other hand, the Joint Investigation Headquarters emphasized the importance of the crime along with the fact that President Yoon refused to comply with the summons three times.
It pointed out the circumstances in which the president plotted martial law several times in advance and ordered the control of the National Assembly.
In this regard, there was also testimony that President Yoon said at the time of martial law, "Take out the lawmakers even by shooting" or "You can do martial law two or three times."
Unlike arrest warrants, which are requested when the principal suspect runs away or there is a risk of eliminating evidence,
The
arrest warrant is a legal procedure to force an investigative agency to investigate if a suspect of a crime refuses to comply with the request for attendance.
In the end, President Yoon's investigation is expected to face a major inflection point depending on what judgment the court will make.
