Constitutional Court Becomes 'eight-member' in 75 days...Impeachment trial possible

As Acting President Choi Sang-mok appointed two judges first, the Constitutional Court first escaped from the "six-member system."

The Constitutional Court, which became an "eight-member system" in 75 days, will be able to hear and sentence the impeachment case.

The Constitutional Court reiterated that the nine-judge system should be completed as soon as possible for the stability of state affairs and a fair trial.

He also complained of the burden of work, saying that each chief judge is in charge of one to four impeachment cases.

Acting President Choi Sang-mok announced that he would appoint political candidates and Cho Han-chang, and the Constitutional Court will operate under an eight-member system.

Two judges, each recommended by the ruling and opposition parties, were deployed, leaving the "six-member system" in 75 days.

The appointment of Ma Eun-hyuk, a candidate recommended by the Democratic Party, is still on hold, but the "eight judges" are the same as when former President Park Geun Hye was fired in 2016.

According to the Constitutional Court Act, the court can hear a case with the attendance of more than seven out of nine judges.

In addition, six or more judges may be consented to an impeachment trial.

Now, in a kind of "temporary system" based on a provisional injunction citation, six justices heard President Yoon Suk Yeol's impeachment case,

8 person system, there is nothing legally wrong with the case hearing and decision making.

However, with the eight-member system, it may be burdensome to make the historical decision of the presidential impeachment trial.

This is because it may be pointed out that it did not fully reflect the various views of the nine justices.

The Constitutional Court did not say much about the appointment of two judges, but the addition of two more people slightly eased the burden of work.

In particular, as the controversy over incomplete hearings is over, the Constitutional Court is expected to speed up the hearing of major cases, including the impeachment trial of President Yoon.
