Lee Jae-seung, deputy chief of the Airborne Division, met with reporters today (6th) and argued that the Prosecutor's Office Act and the Criminal Procedure Act can be applied mutatis mutandis in accordance with Article 47 of the Airborne Division Act, and that there is a legal basis for entrusting the police to execute arrest warrants.
According to Article 81 of the Criminal Procedure Act, judicial police can execute warrants under the direction of prosecutors, and the same is true for prosecutors in the Senior Civil Servant Corruption Investigations Unit.
However, there is a wide range of interpretations in the legal profession as there have been no cases in which the prosecutor has entrusted the police with the execution of the arrest warrant.
Earlier, President Yoon's lawyers raised the issue that it is illegal for the police task force to execute arrest warrants, saying that they do not have the authority to direct the police to the Senior Civil Servant Corruption Investigations Unit.
