A doctor who only prescribed enteritis drugs to a suspected sepsis patient and sent him home was found not guilty by the Supreme Court.
The Supreme Court reversed the original ruling, which sentenced doctor A, who was charged with professional negligence, to 10 months in prison and two years of probation, and sent the case back to the Changwon District Court.
Earlier, the first and second trials found A guilty, saying that he was a medical specialist and was able to sufficiently predict and treat the victim through general chemical tests.
However, the Supreme Court judged that it is difficult to say that A's diagnosis of acute enteritis as the cause of the victim's digestive system pain was beyond the scope of the diagnosis in clinical medicine.
He also explained that it is difficult to say that A could have predicted that the condition would deteriorate so rapidly that the victim died in a day.
Mr. A is accused of returning home in October 2016 after only general treatment, such as giving enteritis medicine to a patient complaining of abdominal pain.
The victim was taken to the emergency room with cardiac arrest in a day and eventually died, and multiple organ failure was the cause.
