The Supreme Court strongly criticized that if it was true that incumbent judges were included in the list of demands by the military to track the location after the declaration of emergency martial law, it was a violation of the jurisdiction.

The Supreme Court said that if it tried to arrest an incumbent judge who acquitted Lee Jae-myung, the leader of the Democratic Party of Korea, it would be a direct and serious violation of the jurisdiction, and that serious concerns could not be avoided.

He then stressed that this should never happen in a rule of law and that rapid fact-finding and strict legal responsibility should follow.

In addition, the Seoul Central District Court, where the judge belongs, also criticized the act as a serious violation of the independence of the trial on the grounds that if the relevant contents are true, they cannot accept the trial results of a specific case.

Furthermore, he emphasized that the order alone can only be seen as a serious violation of the principle of separation of powers in the constitution.
