The prosecution believes that the martial law arrest group, which mobilized the military and police, is the key to proving the purpose of the national constitution.
In response, the police immediately protested, and former Defense Minister Kim Yong-hyun claimed that it was a "natural martial law work under the decree."

The prosecution is investigating the situation in which the Defense Security Command asked the police for support to arrest National Assembly Speaker Woo Won-sik, Democratic Party Chairman Lee Jae-myung, and People's Power Representative Han Dong-hoon at the time of martial law.
[Lee Hyun-il / Director of the National Police Agency's Investigation and Planning Division (National Assembly Administration and Security Committee on the 23rd): The counterintelligence agency is going toward the National Assembly, and 'arrest personnel' are coming, the scene is confusing, so we need personnel to guide....]
In particular, it is reported that former Defense Minister Kim Yong-hyun gave specific instructions, such as asking the police to track the location of key figures through Yeo In-hyeong, commander of counterintelligence.
In response, the police countered that there was no perception that the 10 homicide detectives who were dispatched to the scene were arresting anyone.
He also filed a quasi-appeal process, saying the prosecution's search and seizure of Woo Jong-soo, the head of the National Investigation Division, was unfair.
Former Minister Kim's side also refuted the claim, arguing that the arrest team's activities were legitimate.
As the decree banned political activities at the time, it was to prevent politicians from engaging in prohibited activities.
[Lee Ha-sang / Former Defense Minister Kim Yong-hyun's lawyer: Since political activities are prohibited (in the decree), people who do politics have no choice but to do them. You can think of it as a preventive activity for those people. The minister has no idea that the judge is on the list.
However, while pointing out that Proclamation No. 1 itself, which banned political activities, is unconstitutional, there is also a series of testimony from officials that they felt that the order related to "arrest" was inappropriate even at the time of martial law.
The arresting group is a key clue to the purpose of the National Constitution to paralyze the function of the National Assembly, a constitutional institution,
The prosecution is expected to include specific circumstances in former Minister Kim's indictment on charges of rebellion.
